The Vlaams Instituut Voor De Eerste Lijn, with registered office at 76 Lakensestraat in 1000 Brussels, company number 0720.947.550 (hereinafter referred to as “VIVEL“, “we” or “us/our“) hereby undertakes, acting as the data controller, to comply with applicable laws and regulations governing the protection of personal data, including albeit not limited to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (“GDPR“), as well as all and any applicable national laws and regulations implementing the said Regulation (“Applicable Privacy Laws“).

In the present Privacy statement (hereinafter referred to as the “Privacy Statement“) for the VIVEL Academie platform, and by extension webinars (hereinafter referred to as the “VIVEL Academie“), we explain how we process your personal data when you (hereinafter referred to as the “User“, “you” or “your“) use the VIVEL Academie, what your rights are and how you can exercise said rights. For the purposes of the present Privacy Statement, terms such as “personal data”, “processing”, “processor” and “data controller” shall have the meaning ascribed to them in the Applicable Privacy Laws.

Our websites sometimes contain links to third party sites. The use of your personal data by these third parties is not covered by the present Privacy Statement. Please carefully read the privacy statement of the said third parties to learn more about their use and protection of your personal data.

2. Overview of the processing of personal data by VIVEL

Below is an overview of the types of personal data we process as part of VIVEL Academie, the purposes for which we process them and the applicable legal basis.

2.1. Personal data

As part of the VIVEL Academie, VIVEL collects the following personal data of its Users:

  • Identity and contact details (name, phone number, (email) address, etc.);
  • Professional details (primary care zone, occupation, place of work, etc.);
  • Data relating to the training courses taken (attendance, learning statistics, etc.)
  • Personal data collected via functional and analytical cookies.

2.2. Purpose and legal basis

We collect and process the above personal data of Users for the following purposes:

  • The management and organisation of VIVEL Academie: these processing operations are conducted based on our legitimate interest.
  • Follow-up of training courses and activities attended and issue of certificates: these processing operations are conducted based on the requirement to perform the agreement;
  • Monitoring trends and analysis results relating to training courses: these processing operations are conducted based on our legitimate interests;
  • We process the personal data collected by way of cookies in compliance with applicable laws and regulations in this context either based on your prior consent (i.e. for non-strictly necessary/functional cookies) or based on our legitimate interest (i.e. for strictly necessary/functional cookies). Please note that where the processing of personal data is a legal or contractual requirement, the refusal or inability to provide such personal data may prevent us from participating in VIVEL Academie.

3. With whom do we share your personal data? 

When you register as a participant in VIVEL Academie we will share your personal data with third parties who provide us with services with a view to enabling VIVEL to deliver VIVEL Academie. This includes the following categories of third parties:

  • Third parties that maintain VIVEL Academie;
  • Third parties responsible for the analysis of personal data aimed at improving VIVEL Academie;
  • Third parties responsible for monitoring attendance;
  • Outside trainers and instructors of VIVEL Academie with whom we share your personal data in consideration of their requirements in order to enable them to perform their duties. We put in place contracts with the said outside trainers and instructors specifying that these personal data may not be used for commercial purposes.

VIVEL concludes processing agreements with these third parties in compliance with the Applicable Privacy Laws, which enables us to ensure that these parties too implement the relevant measures to guarantee that your personal data are duly protected.

4. International transfers

In the event we transfer your personal data to a third country or an international organisation (i.e. outside the EEA), we will ensure that, in principle, your personal data are transferred only to third countries which the European Commission considers as providing an “adequate” level of protection (a list of countries deemed “adequate” is available to be consulted on the European Commission’s website), or if your personal data are not transferred to a country that provides an adequate level of protection, we will put in place appropriate safeguards with the entity receiving your personal data (e.g. EU standard contractual clauses or binding corporate rules) to ensure that your personal data continue to be protected in compliance with Applicable Privacy Laws.

5. How long do we keep your personal data on file? 

In compliance with Applicable Privacy Laws, your personal data will be retained for as long as we have a legitimate business need to process them, e.g. for certain personal data a maximum retention period of 10 years applies after you have signed up with VIVEL Academie, or for a reasonable length of time in accordance with our legitimate retention interests. Where we no longer have a legitimate business need to process your personal data, we will anonymise or delete them, or if this is not possible, we will securely store and isolate your personal data from further processing until deletion is possible. Where we wish to keep your data for a longer length of time after all, we will ask for your express permission.

6. How do we secure your personal data?

VIVEL makes every effort to protect your personal data at all times. Various functions within VIVEL oversee compliance with Applicable Privacy Laws and the protection of your personal data, our infrastructure and systems.

Moreover, the number of employees within VIVEL vzw who have access to your data is restricted and carefully selected. These employees are bound by strict confidentiality obligations and are trained to handle your personal data in compliance with the law. Moreover, these employees will be granted access to your personal data only insofar as they need access in order to duly perform their duties within the context of VIVEL Academie.

7. Your rights and how to exercise them 

Insofar as applicable and in compliance with Applicable Privacy Laws, you may exercise your rights in respect of the processing of your personal data by VIVEL as detailed below within the context of VIVEL Academie:

  • You may request access to and a copy of all personal data we have processed about you;
  • You may also request that any personal data that are incorrect or incomplete be rectified or completed;
  • You may ask for your personal data to be erased;
  • You may object to the processing of your personal data, ask us to restrict the processing of your personal data or request the portability of your personal data.
  • You may also object , free of charge, to the processing of your personal data for direct marketing purposes by contacting VIVEL at the e-mail address below (Title 9) or by using the unsubscribe link specified in all direct marketing communications.
  • Where we collect and process your personal data with your consent, you may withdraw your consent at any time. However, the withdrawal of your consent shall not affect the lawfulness of any processing based on your consent prior to the withdrawal.
  • You have the right to enter a complaint with a supervisory authority.

8. Amendments

We may update the present Privacy Statement from time to time to reflect business, legal or technical developments. In all cases, the date of the latest update is shown at the top of the present Privacy Statement.
