VIVEL VZW: Terms and conditions for the use of the VIVEL digital platform

    1. Definitions and identification

    These terms and conditions for the use (hereinafter "Terms of Use") of the digital platform (hereinafter "Platform") of the Flemish Institute for First Line, with registered office at Rue de Laeken 76 1000 Brussels, company number 0720.947.550 (hereinafter "VIVEL", "we", "us") apply to all users of the Platform (hereinafter "User(s)", "you" or "your").

    The identification of authorized Users of the Platform and the roles/capacities in this regard are further clarified in the following document: mapping_rollen_teams_digitaalplatform, which document is hereby also an integral part of these Terms of Use.

    2. Context and compliance Terms of Use

    The Platform may, as in Title 3. play a particularly reinforcing role in the rapid sharing of information and dialogue on certain issues.
    Due to the open nature and size of the Platform, these Terms of Use are intended to establish the terms and conditions regarding the use of the Platform in the light of the general Objectives (as defined below in Title 3.), as well as regarding the authorized access to the Platform, the Content (as defined below in Title 4.) on the Platform, the style used on the Platform and the sharing of data/information/Content in the context of the Platform.

    In any case, each User of the Platform fully agrees to these Terms of Use by his/her use.

    Without prejudice to VIVEL's right to impose specific sanctions or measures against the User(s) concerned (e.g. denying or restricting access to the Platform) or to demand and without prejudice to VIVEL's right to compensation or to apply any other remedy for non-compliance with these Terms of Use, VIVEL reserves the right to remove Content that, in its reasonable opinion, is in any way inconsistent with any other provision of these Terms of Use without notice.

    3. General objectives of the Digital Platform

    With the Platform, VIVEL aims to offer a future-proof, dynamic, agile and flexibly deployable digital platform that is in line with the following general objectives of VIVEL (hereinafter referred to as "Objectives"):

    • Sharing knowledge and expertisein the field of well-being, health, health promotion, prevention, ;
    • Dialoguebetween front-line actors;
    • Promoting cooperation;
    • The support of the care councils.

    Users may therefore only use the Platform in the light of these Objectives.

    In the context of the Caring Neighbourhoods, the digital platform is used for the following objectives:

    With the Platform, VIVEL aims to set up a communication channel for the at least 100 Caring Neighbourhood Projects that were set up in the context of the call for projects of Flemish Minister Beke. The platform will be active until at least the final symposium in April 2024. General objectives are:

    • Sharing knowledge and expertise;
    • Offering a training and support offer
    • Dialogue between caring neighbourhood actors;
    • Promoting cooperation;
    • The support of the projects.

    Users may therefore only use the Platform in the light of these Objectives.

    4. Specific provisions on the use of the Platform

    4.1. Content

    In principle, all information, including but not limited to texts and/or images (hereinafter referred to as "Content") that contributes to the Objectives can be placed on the Platform, insofar as and to the extent that this is not limited by copyrights.

    However, each User must comply with the following conditions with regard to the content of this Content:

    • Texts or images that contain sensitive information about other Users, employees, directors, persons with a need for care or support (hereinafter referred to as 'PZONs') or organisations involved may not be posted or shared on the Platform. In any case, the exchange of such sensitive information/Content must take place via a one-on-one contact or via a closed Teams channel and only in encrypted documents.
    • The Platform may in no way be used for Content that is knowingly detrimental, in any way whatsoever, to the reputation of other Users, employees, directors, PZONs, involved organizations or any other third party.
    • Content that leads or reasonably could lead to an affront to the dignity, honour, good name, psychological or physical integrity of other Users, employees, directors, PZONs or any other third party is not permitted.

    4.2. Style

    Without prejudice to the other agreements as set out in these Terms of Use, Users must at all times comply with the following general style rules when using the Platform:

    • Communicate in a respectful manner;
    • Communicate as clearly as possible;
    • Also respect your professional secrecy and agreements within your organisation or board on the Platform;
    • Always make it clear whether you are speaking on your own behalf or whether you are speaking on behalf of a group/board/... Does;
    • Don't be afraid to ask questions and indicate by a 'like' that the question asked by a colleague is also your question.

    4.3. Restriction on sharing content on the Platform

    By posting content on this Platform, you give permission to share this data within the platform. However, you can always explicitly indicate when posting content that it may not be shared, by adding a copyright or mentioning the text 'not for publication'.

    The information shared on the Platform

    • Must always contain the correct acknowledgement of the copyright owner's source.
    • May only be shared for non-commercial use.
    • Must not contain sensitive information.

    4.4. Accessibility

    Members of a team who have the role of owner can add or remove Users. They can also (temporarily) add guest Users to the team.

    Adding or removing a User or guest User is the sole responsibility of the owner. He/she always takes into account the role and assignment of the person concerned.

    5. Limitation of Liability

    Liability for Content on the Platform and for any unauthorized or otherwise unlawful use of the Platform lies solely with the User(s) concerned and their team. To the extent and to the extent permitted by law, the following parties cannot be held liable for this:

    6. Modifications

    We may update these Terms of Use from time to time to comply with business, legal, or technical developments. The date of last modification can always be found at the top of these Terms of Use. When we update our Terms of Use, we will take appropriate steps to inform you or obtain your consent, depending on the significance of the changes and the legal requirements in this regard.
