VIVEL VZW – PRIVACYVERKLARING

    Inleiding

    Het Vlaams Instituut voor de Eerste Lijn, met maatschappelijke zetel te Lakensestraat 76 1000 Brussel, ondernemingsnummer 0720.947.550 (hierna “VIVEL”, “we/wij” of “ons/onze”) verbindt zich als verwerkingsverantwoordelijke om te voldoen aan de toepasselijke wetgeving inzake de bescherming van persoonsgegevens, met inbegrip van maar niet beperkt tot Verordening (EU) 2016/679 van het Europees Parlement en de Raad van 27 april 2016 betreffende de bescherming van natuurlijke personen met betrekking tot de verwerking van persoonsgegevens en het vrije verkeer van dergelijke gegevens, en tot intrekking van Richtlijn 95/46 / EG (“AVG”), evenals elke toepasselijke nationale wetgeving ter uitvoering daarvan (“Toepasselijke Privacywetgeving”).

    In deze privacyverklaring (hierna “Privacyverklaring“) lichten we toe hoe VIVEL persoonsgegevens verwerkt in het kader van de samenwerking, het platform van de VIVEL Academie (hierna “VIVEL Academie”) en het deelplatform dat VIVEL, de website mantelzorgers.be en de website van ELZ.BE die zij ter beschikking stelt. Daarnaast worden uw rechten en hoe u deze kan uitoefenen uiteengezet.

    Overzicht van de verwerking van persoonsgegevens door VIVEL

    Below we provide an overview of the types of personal data we process, the purposes for which we process it and the applicable legal basis.

    2.1. Personal data

    In the context of VIVEL Academy, VIVEL collects the following personal data from Users:

    • Identification and contact details (name, telephone number, (e-mail) address, etc.);
    • Professional data (first-line zone, profession, place of employment, etc.);
    • Data relating to courses taken (participation, learning statistics, etc.)
    • Personal data via the contact form on the website www.vivelacademie.be
    • Personal data collected through functional and analytical cookies.

    In the context of the sharing platform, which includes hosting an environment in Microsoft, Yammer, Teams, SharePoint, OneDrive and other Microsoft tools for storing documents and creating channels, VIVEL processes the following data regarding the use of the platform: 

    • Datum, tijdstip en locatie; 
    • Affected application;
    • IP address; 
    • Authenticatievorm. 

    In het kader van evenementen en/of opleidingen die gepubliceerd worden op de website van ELZ.be en waarbij VIVEL betrokken is in de organisatie van dit evenement of opleiding, verwerkt VIVEL de volgende gegevens:

    • Naam, voornaam;
    • Woonplaats;
    • Emailadres, telefoonnummer;
    • Functie, organisatie;
    • RIZIV-nummer.

    2.2. Purposes and legal basis

    We collect and process the above-mentioned personal data of Users for the following purposes:

    • Het beheer en de organisatie van VIVEL Academie en het deelplatform: deze verwerkingen gebeuren op grond van ons gerechtvaardigd belang.
    • Het informeren van leden aan de hand van nieuwsbrieven over de activiteiten van VIVEL en VIVEL Academie: deze verwerkingen gebeuren op grond van toestemming. 
    • Het opvolgen van gevolgde vormingen en activiteiten en uitreiken van certificaten: deze verwerkingen gebeuren op grond van de noodzaak voor de uitvoering van de overeenkomst;
    • Het opvolgen van trends en analyseresultaten met betrekking tot vormingen: deze verwerkingen gebeuren op grond van ons gerechtvaardigd belang;
    • De verwerking van gegevens in het kader van opleidingen en evenementen vindt plaats zodat VIVEL in staat is om te factureren bij annulatie of voor verdere communicatie van de desbetreffende activiteit: deze verwerkingen gebeuren op grond van de noodzaak voor de uitvoering van de overeenkomst;
    • De verwerking van het RIZIV-nummer bij opleidingen die georganiseerd worden in samenwerking met de Eerstelijnszones vindt plaats in het kader van accreditatie: deze verwerking gebeurt op grond van de noodzaak voor de uitvoering van de overeenkomst;
    • De persoonsgegevens die door gebruik van cookies verzamelen, verwerken we conform de toepasselijke wetgeving in dat kader ofwel op grond van uw voorafgaande toestemming (i.e. voor niet-strikt noodzakelijke/functionele cookies) ofwel op grond van ons gerechtvaardigd belang (i.e. voor strikt noodzakelijke/functionele cookies).     Please note that where the processing of personal data is a legal or contractual requirement, the refusal or inability to provide this personal data may prevent us from participating in VIVEL Academy and/or the Sharing Platform.

    Met wie delen wij uw persoonsgegevens? 

    When you register as a participant of VIVEL Academy or the VIVEL sharing platform, we will share your personal data with third parties who provide services to us with a view to VIVEL's provision of the Academy and the sharing platform. This includes the following categories of third parties:

    • Third parties that maintain VIVEL Academy or the Sharing Platform;
    • Third parties who are responsible for the analysis of personal data in order to improve VIVEL Academie and the sharing platform;
    • Third parties who are responsible for the follow-up of attendance;
    • External trainers and trainers of VIVEL Academie with whom we share your personal data in the performance of their assignment. We agree with them that this personal data cannot be used for commercial purposes.

    VIVEL sluit met deze derden de nodige overeenkomsten overeenkomstig de Toepasselijke Privacywetgeving. Op die manier kunnen wij waarborgen dat ook zij passende technische en organisatorische maatregelen treffen ter bescherming van uw persoonsgegevens.

    Internationale doorgifte

    In the event that we transfer your personal data to a third country or international organisation (i.e. outside the EEA), we will ensure that your personal data is in principle only transferred to third countries that are deemed by the European Commission to provide an "adequate" level of protection (a list of adequate countries is available on the European Commission's website), or if your personal data is not transferred to a country that provides an adequate level of protection, we will put in place appropriate safeguards with the entity receiving your personal data (for example, the EU Standard Contractual Clauses or Binding Corporate Rules) to ensure that your personal data remains protected in accordance with the Applicable Privacy Laws.

    Hoe lang bewaren wij uw persoonsgegevens? 

    In accordance with the Applicable Privacy Legislation, your personal data will be retained for as long as we have a legitimate business need to process it, for example, for certain personal data, a maximum retention period of 10 years after enrolment in VIVEL Academie or for a reasonable period of time in accordance with our legitimate interests for retention. When we no longer have a legitimate business need to process your personal data, we will anonymise or delete it, or if this is not possible, we will securely store your personal data and isolate it from further processing until deletion is possible. If we wish to keep your data for a longer period of time, we will ask for your explicit permission to do so.

    Hoe beveiligen wij uw persoonsgegevens?

    VIVEL makes every effort to protect your personal data at all times. Various functions within VIVEL oversee compliance with the Applicable Privacy Legislation and the security of your personal data, our infrastructure and systems.

    Moreover, the number of employees within vzw VIVEL who have access to your data is limited and carefully selected. These employees are bound by strict confidentiality obligations and are trained to handle your personal data correctly. Moreover, these employees will only be granted access to your personal data insofar as they need it to properly perform their tasks within the framework of VIVEL Academy or VIVEL's sharing platform.

    Uw rechten en hoe deze uit te oefenen 

    To the extent applicable and in accordance with the Applicable Privacy Legislation, you can exercise the following rights with regard to the processing of your personal data by VIVEL in the context of VIVEL Academy and the sharing platform:

    • U kunt toegang vragen tot en een kopie krijgen van alle persoonsgegevens die we over u hebben verwerkt;
    • U kunt ook vragen dat alle persoonsgegevens die onjuist of onvolledig zijn, worden gecorrigeerd of aangevuld;
    • U kunt vragen om uw persoonsgegevens te wissen;
    • U kunt bezwaar maken tegen de verwerking van uw persoonsgegevens, ons vragen om de verwerking van uw persoonsgegevens te beperken of om overdraagbaarheid van uw persoonsgegevens verzoeken.
    • U kunt ook kosteloos bezwaar maken tegen de verwerking van uw persoonsgegevens voor direct marketing doeleinden door contact op te nemen met VIVEL via het onderstaande e-mailadres (Titel 9) of door de uitschrijf-link te gebruiken in elke direct marketingcommunicatie.
    • Als we uw persoonsgegevens met uw toestemming verzamelen en verwerken, kunt u uw toestemming op elk moment intrekken. De intrekking van uw toestemming heeft evenwel geen invloed op de rechtmatigheid van enige verwerking op basis van uw toestemming vóór de intrekking.
    • U heeft het recht om een klacht in te dienen bij een toezichthoudende autoriteit.

    Aanpassingen

    We may update this Privacy Statement from time to time to comply with business, legal, or technical developments. The date of last modification can always be found at the top of this Privacy Statement. When we update our Privacy Notice, we will take appropriate steps to inform you, depending on the significance of the changes and the legal requirements in this regard.
